The FCC State Regulatory Attorney focuses primarily on all areas of legal advice related to pole attachments, the joint use of utility infrastructure, support for broadband deployment, and other aspects of interplay between FirstEnergy’s electric operations and the various elements of the cable, telecommunications, and broadband industries.  The attorney works directly with business units, department lawyers and outside counsel on related regulatory matters, including proceedings before the Federal Communications Commission and state regulatory commission(s), with the assistance of dedicated state regulatory counsel as appropriate to the jurisdiction.

 

This individual advises internal clients with respect to relevant statutory and regulatory requirements, new developments, and significant issues, including FCC and state commission rates, regulations, and orders pertaining to pole attachments and the joint use of utility infrastructure.  This position involves a meaningful amount of legal writing, review and analysis, coordination with outside counsel, and independent case management of relevant utility tariff, litigation, and rulemaking proceedings.

 

The FirstEnergy Legal department provides exceptional counsel that assures legal compliance and enables FirstEnergy to optimize business outcomes in all legal, regulatory, and commercial contexts. The Legal department is involved in every major activity and initiative involving all entities of FirstEnergy Corp. 

 

Responsibilities include:
 

  • Handling legal/regulatory matters before the FCC, state utility commission(s) and appellate courts
  • Working on complex regulatory matters as part of a team that includes attorneys, business units, and outside counsel
  • Handling aspects of multiple ongoing cases and matters simultaneously
  • Drafting and/or reviewing legal pleadings and business documents
  • Representing the Company in negotiations, mediation, and litigation of attaching entity disputes
  • Providing legal support and strategic and business advice to FirstEnergy business units on FCC and state regulatory matters
  • Assisting, handling, and managing, as applicable, regulatory matters before the FCC and various state public utility regulatory agencies
  • Working on litigated matters and administrative rulemaking proceedings

 

Qualifications

 

  • J.D. degree from an accredited university is required.
  • Minimum 2 years relevant work experience is required.  Relevant work experience includes practicing law, legal writing and handling complex legal matters specific to FCC jurisdictional issues related to FCC rates, regulations, and orders pertaining to pole attachments and the joint use of utility infrastructure.
  • Licensed attorney in good standing; member of Ohio, West Virginia, New Jersey, Pennsylvania and/or Maryland state bar preferred.
  • Solid written and oral communication skills
  • Able to work with all levels within the organization
  • Strong work ethic, initiative, and organizational skills
  • Demonstrated willingness and ability to understand new topical areas
  • Able to multitask and manage time to adhere to strict deadlines
  • Prior experience related to state public utility regulation and practice before state regulatory utility commissions preferred
  • Electric utility industry experience helpful
  • Able to work both independently and as part of a team on complex matters
